Repeat DUI Defense in New York

A first-time DWI in New York is considered a misdemeanor crime. A second DWI within 10 years of the first is considered a felony crime. The consequences for a second or subsequent DWI conviction become increasingly severe. A second DWI conviction within 10 years may result in the following:

  • Fines between $1,000 and $5,000
  • One-year license revocation
  • Five to 30 days in jail (or community service)

The penalties increase for each subsequent DWI conviction.

Ignition Interlock Device

Courts in New York may now require the installation of an ignition interlock device to any vehicle whose owner has been convicted of DWI. Before starting a vehicle, the driver must blow into the ignition interlock device, which tests the driver's breath. This applies to first-time and repeat offenders, and stays on the vehicle for a minimum of six months.
